On their part, tenants should report minor or major issues as they come. On your part, you should conduct routine inspections according to the law. Document the unit in detail well before the tenant moves in to keep track of any differences.

Determining Responsibility

In some cases, it may be pretty evident what caused the rental property damage. Unnecessary damage can come from tenant property abuse or unruly pets. It can also be the result of natural old age, improper installation, or an accident. 

If you believe the tenant has committed vandalism or theft, call the police. If it is a minor cause that is clearly the tenant’s, the tenant should be held responsible for paying. If the cause is unclear or evident from natural wear and tear, it is the landlord’s responsibility and expectation to take care of it.

No matter who is responsible, it is the landlord’s job to repair the property damage and keep the place habitable and comfortable, as if he lived there himself. The landlord should document the damage well, check with the insurance company to see if they can cover the cost, get a few estimates from reputable contractors, and hire the best one to come at a time convenient for the tenant. Communicate clearly with the tenant throughout the process and charge the tenant for the repairs if they are responsible.
